12/28/17 Bronx 5th Alarm Box 3303

I'm sure it won't be easy for the mother of this child that started the fire, plus the fact that she left the door open allowing the fire to spread causing this very tragic event.

Some have been asking if the mother is being charged with anything which led up to this. Is it possible that she could face some criminal charges for this ? I would think it would be listed as an accident caused by a child. Or in the case of not closing the door, an urge to escape without thinking. A chain of events but nothing criminal.

I didn't see that she was arrested on any charges. Can she still face charges for this ?

I wonder about possible lawsuits against her by other tenants, although I'm not sure what her value would be.

It may be determined that there is already enough grief without charging the mother.  However, NYC Child Protected Services may become involved to see if the mother is fit to keep the child.

Borocall, Thank you. What you say is a very good possibility. In just a few moments the lives of so many people changed forever.

I had asked this question because in the local newspaper online here, so many people have wrote comments asking if the mother was arrested or charged with anything. Most feel she should be. But I'm sure she lost friends that lived in that building also.

It has also been mentioned that they sell child proof knobs for stoves to prevent such a thing. I wasn't aware of that.

Regardless of what the outcome is for this mother, she will live with the fact that she caused this tragedy to happen.

Thanks G-man for posting that NY Post story as well. Something that those who responded to or answered the desperate 911 calls won't forget either.

a few hits of that rubber/plastic/chemical fueled smoke over a few seconds is all it takes. 
to make matters worse we see it all the time with fire escape windows having child bars on them, security window gates that are rusrted shut or are locked and the key is missing, no smoke alarms or alarms with no battery, apt doors that dont slam shut, bulkhead roof doors that are illegally locked with padlocks.  landlords and building owners just dont care.  BISP can only find and fix so much.  residents need to be better informed on what to do when there is a fire and/or emergency
 
My thoughts and prayers go out to the victims and the firefighters and medics who responded to this incident. The articles in the Post tell what the troops responded to and how they handled the situation. May the good Lord watch over them and bless them all.

There are a great many different types of child proofing items/equipment for use in the home, and the FDNY educational unit does a very good job informing about child proofing.  But, and there is always a "but" in order for child proofing to work - the information given has to be acted on, by parents, landlords, building owners, and the acting on part, is a great deal of the problem.  It would be good if the NYC Council would come up with a bill/new law requiring very stiff penalties for anyone not adhering to child safety laws, regulations.

If something positive comes from this tragedy, perhaps child safety laws/regulations/penalties would be it!!

Have been pleasantly surprised by the follow-up stories in the NY Post since the fire. Instead of a one day story (12 people died), the reporters have related the heart breaking tragedies of the victims and families, and the interviews with the Bn18 and the EMS chief gave us an insight into the initial moments of that tragic night and the conditions they had to deal with.

Private 1st Class Emmanuel Mensah died on December 28th, 2017, after rescuing 4 people during the 5th Alarm at Bronx Box 3303 2263 Prospect Ave. The US Army posthumously awarded him The Medal of Valor for his actions on that day. The funeral will be held at Our Lady of Mt. Carmel Church, 627 East 187th Street, Bronx, NY 10458 on Saturday, February 17th, 2018, at 10:00 am.

I still think the flags should have been/should be at half-staff for him.  Being they were put to half staff for the deaths at the Fl. school.
