Commissioner Kelly Says Protests Could Go On Indefinitely

LOWER MANHATTAN ? Police Commissioner Ray Kelly said cops are preparing for the Occupy Wall Street protest to last indefinitely.

?People are going to be here for an extended period of time. We?re going to accommodate them as long as they do it peacefully and in accordance with the laws and regulations," Kelly told reporters following a City Council hearing Thursday.

But he said that neither police nor executives from Brookfield Properties, which owns Zuccotti Park, have the authority to kick the protesters out at this point.

The park, where demonstrators have been encamped for three weeks, is privately owned but operates as a public space that must be open 24-hours-a-day under an agreement with the city.

"Right now, they are there and the owners of that plaza don?t have the legal right to eject them,? Kelly said.

The commissioner explained that Zuccotti Park was built by Brookfield in exchange for zoning variances, and that as part of the developer's contract, the public is entitled to round-the-clock access.

Brookfield recently posted a list of regulations at the park ? including bans on sleeping bags and tarps as well as a prohibition against lying down on benches, sitting areas and walkways ? but Kelly said that police could not intervene.

?You would need a legal basis to do that. And what I?m saying is the public has a right to access that piece of land. So this has to be worked out legally," he said.

Brookfield spokeswoman Melissa Coley declined to discuss the original agreement for the plaza, the conditions for modifying the the terms of that agreement, or comment on whether the rules have any legal standing.

But in a statement, she criticized the protesters for failing to heed the rules, which were recently posted on signs.

"Unfortunately, many of the individuals currently occupying the grounds are ignoring these basic yet necessary requirements, which interferes with the use of the park by others, including local residents, office workers and visitors," she said.

Coley declined to say whether Brookfield has asked police to intervene.

"We continue to work with the City of New York to address these conditions and restore the park to its intended purpose," she said.

Raju Mann, a director of planning at the Municipal Art Society of New York, who was formerly with the Department of City Planning, said that in order to close the plaza, Brookfield would need approval from the Department of City Planning ? a process that typically takes several weeks or months.

Mann said whether police can intervene to enforce other rules is less clear.

?There is lot of gray area about what activities are permitted in a privately owned public space," he said.

The Department of City Planning did not immediately respond to a request for comment about whether any applications for modifications of the agreement have been filed.

Kelly's comments Thursday came after an NYPD detective addressed Community Board 1's Financial District Committee about the issue Wednesday night ? as thousands of protesters flooded lower Manhattan's streets in the largest demonstration yet.

Det. Rick Lee, a community affairs officer at lower Manhattan's First Precinct, told community members that Brookfield is responsible for creating the rules that park visitors must follow, and suggested the NYPD would be able to remove people from the park at Brookfield's request if protesters broke those rules.

"A representative for Brookfield would go into the park and say, 'You're in violation of the rules of the park. You have to leave,'" Lee told the committee Wednesday night.

"If they don't leave, they're trespassing. Then the police would get involved? When that button is going to be pushed?I couldn't tell you."

A metal sign in Zuccotti Park outlining Brookfield's rules for the space was mostly torn down as of Thursday morning.

Downtown residents at the meeting reiterated their complaints about the impact Occupy Wall Street is having on their lives.

"You supposedly work for the people, but you don't care about these people who live in the neighborhood who are under a tremendous amount of stress," said Ro Sheffe, chair of CB1's Financial District Committee, whose apartment overlooks Zuccotti Park.

"You guys need to be in Greenwich, Connecticut, where the rich people live. The people you're disturbing are middle-class people just like you."

The neighbors' chief complaints include protesters' late-night shouting and drumming, the police barriers that have crippled Downtown's streets and the diversion of police resources to the protest, rather than neighborhood quality-of-life issues.

Justin Wedes, a representative of Occupy Wall Street who attended the meeting, said the protesters agreed to start their quiet hours at 10 p.m. on weeknights in deference to community concerns.

He also promised to take additional community requests back to Occupy Wall Street's General Assembly, including no marching on Yom Kippur, no marching in the street and creating official march routes so police and residents are not caught off guard.

Wedes admitted that the protesters initially thought lower Manhattan was "a rich neighborhood with hedge funders and bankers," and did not realize that many members of the so-called 99 percent lived there, too.

He said the protesters hope to be good neighbors during the rest of their stay, which does not have an end date.

Assembly Speaker Sheldon Silver, who represents lower Manhattan, said Wednesday that the protesters have worn out their welcome and should take their demonstrations elsewhere.

On Wednesday night, CB1's Financial District Committee decided not to pass a resolution condemning the protest but rather to hold weekly meetings with all the involved parties, in an attempt to negotiate a solution.

Kelly said that police are doing their best to work with protesters, despite a confrontation Wednesday night.

?This is our job to accommodate demonstrations,? he said.

NYPD: Only Landlord Can Evict Occupy Wall Street Protesters From Zuccotti Park

As Occupy Wall Street stretches into its third week at Zuccotti Park, it seems the fate of the protest in its current incarnation rests in the hands of the park's landlord?not the NYPD.

According to DNAInfo, an NYPD detective said that the executives of Brookfield Properties, who manage the park, are the only ones who can kick out protesters.

Det. Rick Lee, a community affairs officer at lower Manhattan's 1st Precinct, explained the situation to locals at Community Board 1's Financial District Committee meeting last night. "A representative for Brookfield would go into the park and say, 'You're in violation of the rules of the park. You have to leave.' If they don't leave, they're trespassing. Then the police would get involved." So it's Brookfield's move to make: "That?s the scenario. Politically, when that button is going to be pushed is beyond my pay grade...I couldn't tell you."

Last week, Brookfield officials released a statement saying that the park management recognizes people's right to peaceful protest, but they "also have an obligation to ensure that the park remains safe, clean, and accessible to everyone." It also notes that the park hasn't been cleaned since September 16, one day before the protests began, and that "sanitary conditions have reached unacceptable levels." OWS spokesman Patrick Bruner told us the group was trying to address many of those problems before things got any worse.

But the larger point is that despite his ominous intonations, Bloomberg can't personally remove protesters from the streets of the park. And even if Brookfield doesn't kick them out, protesters have another major problem on the immediate horizon: the weather. Many protesters and OWS organizers are scrambling to find a solution to cold weather conditions, and thus far have only found that they can't afford the proper gear to keep people warm.

In America, we all have the right to protest. Many fought for that right. We loose that right when we become violent against others. What these Wall St protestors are standing up for, I agree with them. Our politicians have been taking care of Wall St for years.  Not for the good of the American people, but for the good of their own political future. And its time people stood up against this.
  But to charge and attack the police officers trying to keep the peace is way beyond our American rights. Those hard working police officers are in the same boat as most of the rest of us. To explain this Wall St issue in simple terms, as I understand it, only 1% of the American people controls 23 % of the entire wealth. While the other 99 % is struggling to be able to survive with the basic necessities of life.

Bill i am in agreement w/ you... also someone on another site asked about Union participation in this particular protest...there are some Unions involved in some portions of the protest....however i think all would agree that you will not see the FDNY/PBA/Corrections  etc etc Unions out there when all you need is a preplanned unlawful action against the NYPD by the more radical factions to cause all present to get caught up in the surge.

Spineless b'bag & the owners of Zuccoti park chickened out...the 7 am park cleaning this morning has been called off......to show thanks the freaks are now marching on city hall.....even though rudy was a shithead...bring him back for a day & the park will be empty.

Early on in this so called "protest" civilian Fire Prevention inspectors confinscated gasoline being used for generators in the park....i would hope that since they started the ball rolling that they followed up on it but it does not look that way.... regarding the administrative Company....i would hope no BROTHER is left holding the bag as happened a few blocks away after the tragic D'Bank Fire.......in my estimation this thing has proven itself to be nothing more than a hippy happening.....they are not delivering any message aside from the fact that these dirtbags are above the law....people bitched about the West Indian day festiva l... well that was only three days long..... this thing has been going on for weeks w/the pissing ,shitting in hallways,drug use etc the only thing missing so far from the WI festival is the shots being fired.......IT'S GUILLY TIME !

We've been getting calls from OEM every day asking if there have been any issues with these mopes. No problems that I've seen. I checked them out about two weeks ago. Not impressed, whatever..

I was watching videos when NYPD went to do their sworn duty. Individuals were scene jumping on INNOCENT civilians cars causing damage which will not be covered my insurance. Put a boot on my car, I will put a boot up ypur ass!! I can understand peaceful demonstration, there are a lot ot people that the economy affects. It has impacted me to an extent, there are things I would like to get for the both of us, but sometimes the money is not there. But we have a roof over our heads, I get to cook, and the dogs, Bear and Austin, are doing OK.  8) 8) :( :( :mad: :mad:

The FDNY is responsible for enforcing the Fire Prevention Code & the Rules of the City Of NY......all summons & violation orders issued to violators by FDNY are "By Order Of The Fire Commissioner".

FEEDING FRENZY: Occupy Wall Street organizers say legitimate protesters like these are being overrun by released Rikers inmates and derelicts who come to Zuccotti Park for the free gourmet meals

Newly sprung ex-cons and vagrants rousted from other parks are crashing the Occupy Wall Street protest, where gourmet meals are free and boozy, drug?fueled parties are on tap, the movement?s leaders griped yesterday.

?They?re telling people who leave prison to go to Zuccotti Park,? lamented Daniel Zetah, a leader of the OWS community-relations group.

Volunteer Lauren Digioia, 26, said, ?We have drug dealing going on here, gang activity, public intoxication. There are a lot of instigators. There are a lot of vultures.

?Everyone knows we give out free food and sleeping bags, and it?s a perfect opportunity for squatters.?

Digioia said she recently met a man who just before getting sprung from Rikers, was told by a fellow inmate to hit Zuccotti for the free accommodations.

The frustrated organizers said they?re brainstorming how to launch a protest within the protest to target the drunken, stoned layabouts.

The derelicts, organizers say, are terrorizing people who are there to support the movement.

?There?s a lot of drugs, alcohol, assault [and] theft [by] the homeless groups coming in. We?ve had meetings all day to brainstorm what to do,?? said Zetah, 34.

The hardened thugs are having a field day preying on overly trusting protesters, many of whom hail from small towns, leaders said.

On Monday, a 24-year-old Brooklyn woman originally from Brownville, Maine ? population 1,260 ? told cops that three men threatened her because she?d fingered one of their pals for brutally punching her and two others, another woman and a man in the face Oct. 11.

?You got our friend arrested. We?re going to kill you. Watch your back,? one of them told her.

Garfield Leslie, 19, of Brooklyn, was later charged with assault and Hasan Castillo, 23, of East Orange, NJ, with intimidating a witness.

And when the undesirables aren?t intimidating protesters, organizers said, they?re adding to the filth.

NYPD spokesman Paul Browne said he was unsure whether ex-cons really are relocating to the encampment.

But he added that ?we?ve made arrests of suspects who assaulted people in Zuccotti Park in one instance, sexually abused a woman in another, and removed an individual who had stolen another?s boots.?

Meanwhile, in other developments yesterday:

* The NYPD inspector who pepper-sprayerd a protestor has been quietly transferred to an administrative post on Staten Island, The Post has learned. Anthony Bologna had been docked 10 vacation days after he was caught on video spraying teacher?s aide Kaylee Dedrick, 24, in the eyes.

His new assignment, as the borough?s special-projects inspector, will ?get him out of the line of fire,?? a source said.

* Four demonstrators headed uptown yesterday to harass Rep. Charles Rangel, who?d twice visited Zuccotti Park to support OWS but drew their wrath by voting for free-trade agreements with South Korea and Panama.

*  A splinter group of OWS protesters and supporters found a new target ? the city Department of Education. More than 100 demonstrators, including teachers, last night disrupted a schools meeting ? shouting down Chancellor Dennis Walcott ? at Seward Park HS on the Lower East Side.

The protesters complained about too much test prep, lack of resources and recent layoffs.

 They?re drowning out the parents, who were the primary focus for tonight,? Walcott lamented to reporters.

* Another Community Board 1 meeting was held to address ongoing concerns over Zuccotti, which is in its area. The board voted 33-3 to limit drumming there to two hours a day.

A motion to clear out all the protesters from part of the park was tabled.

The battle for power at Occupy Wall Street continues! Yesterday firefighters seized a generator belonging to a licensed food vendor who operates a cart on the sidewalk outside Zuccotti Park. The vendor, who has only been identified as Ali, was reportedly running a power cord from his cart to the protesters' media tent. In seizing the generator, the FDNY cited "failure to provide a permit for the storage of gasoline and failure to have a permit to change out propane tanks." Regarding the first violation, Ali tells A Great Big City the gasoline canister was empty. Here's the first video:

A Fire Marshal at the scene explained that in New York City, "The fire code states that an empty gasoline canister is equivalent to a full canister." See, the crackdown on Ali had nothing to do with helping Occupy Wall Street! Here's a second video, recorded after the generator was seized. It shows what appears to be few grouchy undercover cops being scolded by a handful of tenacious protesters, as the offending generator is taken to a nearby firehouse.

The photographer who took the photo above writes, "The number of firefighters who showed up to remove the empty gas container and generator was so silly; they, I think, felt kind of ridiculous, just sort of milling around to no purpose, and in full gear. Unsurprisingly, the NYPD presence was huge as well. And then the news crews were right there, recording the solemn 'handing of the violations' to poor Ali, who looked totally stricken.

"What was funny was, toward the end of drama, an Occupier starting strumming and singing an improvised 'Ballad of Ali's Generator.' Even the cops were cracking a smile at some of the lyrics." The FDNY and an Occupy Wall Street representative did not immediately respond to requests for comment; we'll update if we hear back.

Speaking of generators, don't think the protesters have forgotten about the other ones the FDNY seized last week. Lawyers for the demonstrators have now sent two letters to the FDNY demanding the return of their property. Here's fiery letter number two, in which the attorneys threaten to take the FDNY to court to get the generators back:
