Spares are exempt from that - its overaged assigned rigs which are at least 11 years old that are supposed to be exempt

Nope not splitting hairs - its a good question. Yes they are over 11 years old but they are exempt. Not exactly sure why other than guessing they are maybe proven to be able to handle certain workloads which has deemed them a reliable spare by the shops in the first place.

This prevents the FDNY from giving the busy companies new apparatus and reassigning older apparatus to slower companies as was done in the past. Spares are temporary apparatus usually used during repairs to first line apparatus for whatever reason.

It also makes sure that the capital expenditures budget is prepared properly each year for apparatus replacement and does not become victim to the whims of city hall who would arbitrarily fund this based on their needs for diverting money to there pet projects and re-elect me projects. Ask the members of Chicago and Atlanta and Houston and Detroit as well as many other large cities what happens when you do not have a clause like this in your contract.
 
In the early 1960's Baltimore City FD had a regular pumper replacement program. At the time they had 54 engine companies. Every year, like clockwork, they bought two new pumpers.
